In addition to industrial zone, we know that there are many industrial complexes in Vietnam. We have heard that a regulation on industrial complexes had just been promulgated. Could you tell me the main distinctive features of the industrial complexes under the recent regulation?
Answer:
The rule on management of industrial complexes has just been promulgated under Decision No 105/2009/QD-TTg on August 19, 2009 of the Prime Minister and shall come into force as of October 05, 2009.
An industrial complex established by the Provincial People’s Committee is concentrated area of enterprises, industry and handicraft producing establishments, servicing establishments for industry and handicraft production; has defined geographical boundaries, no residence, is primarily invested for the relocating, organizing and attracting local producing establishments, small and medium enterprises, individuals, households to invest in production and business
An industrial complex shall have the area of 50 hectares or less. In case of expansion of the existing industrial complex, the area after being expanded shall be no more than 70 hectares.
For establishment of industrial complexes, the following conditions must be satisfied: (1) The complexes must be in the approved development plan, (2) the possibility that the area being leased or to be leased is no less than 30 percent of the area used for production, business and service (fulfilling ratio) within one year of operation and (3) having the investors to construct the industrial complexes’ infrastructure.
Whereas, for the expansion of industrial complexes, the following conditions must be satisfied: (1) having the land area in compliance with the land using plan of the district, to satisfy the need of expansion, (2) the land leasing demand in the industrial complexes exceeds the existing area used for production, business and service, (3) the fulfilling ratio have already reached at least 60 percent and (4) the centralized wastewater handling works of over 15 hectares have been constructed.
