The risk for using symbol ® for unregistered trademark in Vietnam
Using the symbol ® for unregistered trademark (has not yet been granted Certificate of Trademark Registration), including printing such indication on the products, goods, services which misleading that trademark enjoys the industrial property rights protection in Vietnam though the applicant is not or has not been eligible for
protection, may be bear a warning or a fine of between VND500,000 and 1,000,000.
In addition, users may be applied remedial measures such as:
- Forcible remove of ® on the goods or means of business
- Forcible public correction of errors.
