FINE UP TO VND 200 MILLION FOR ADMINISTRATIVE VIOLATION OF FOOD SAFETY REGULATIONS

On November 14, 2013, the Government Decree No. 178/2013/ND-CP on sanction of administrative violations on food safety with maximum sanction level of VND 100 million for individuals and VND 200  million for organizations according to specific violated cases. Concretely, a fine of between VND 5 million and 10 million will be applied for using water which fails to meet technical regulations for production and business of food, food additives and food processing enhancers or using detergent and antiseptic chemicals in food production and business in contrary to regulations; a fine of between VND 20 million - 40 million, VND 30 million- 50 million and VND 70 million - 100 million for act of using chemicals not stated in List permitted use, chemicals not identify origin for producing and processing food; act of using ingredients failing to ensure food safety for producing or processing food and using chemicals which are banned use in producing and processing food for thereof.

A fine of between VND 70 million and 100 million for acts of using ingredients not in the category used to make food for producing and processing food; using animals suffered infectious diseases, animals died due to diseases, epidemics or unclear reason, forcibly destroyed at the request of state competent agencies for producing or processing food; using food ingredients which contain impurities put into without food safety assurance for producing and processing food… For act of trading fresh food derived from terrestrial animals which are putrid or have change in color and smell,  a fine of between 80% and 100% of total food value infringed at time of violation but the maximum fine does not exceed VND 100 million (for individual) and VND 200 million (for organizations).

This Decree takes effect on December 31, 2013.
